Bling Boutique Costume Rental Agreement
This website is located at www.blingboutique.com.au (“Website”). Under these Terms of Use, this Website provides a service for customers to borrow dance costumes and accessories from Bling Boutique.
Through the Services, we aim to give you access to our highly finished costumes, and give your dancer the opportunity to wear one of our costumes for that special event or for a short season.
Definitions
In these Terms of Use “you” and “your” refer to all users of this Website and “we’, “us” and “our” refer to www.blingboutique.com.au. References to users must be read as being also a reference to customers of www.blingboutique.com.au.
Legally Binding Contract
These Terms of Use constitute a binding legal contract between you and Bling Boutique. These Terms of Use apply to you whether you are browsing or are a customer of Bling Boutique. The Terms of Use in force at any time are published on the Website and you will be taken to have accepted them by accessing or using the Website. If Bling Boutique develops revised terms of use then on their publication on the Website they will supersede those they replace. If you subsequently access or use the Website you will be taken to have accepted the revised terms of use. If you do not agree with the terms of use application from time to time, do not access, use, submit information to or download from this Website. These Terms of Use may change without notice, so do check from time to time. If you do not agree to any change, you should terminate the use of the Website. Specific Website offerings, incentives, areas, or section may also have additional guidelines which govern your use of this Website. You must comply with them in addition to these Terms of Use.
This agreement contains all of the terms and conditions regarding your rental of products from Bling Boutique via the website www.blingboutique.com.au. You agree that rental from our business is subject to all our website terms and conditions of use and privacy policy. These are available on our website and are subject to change from time to time.
You agree that you are renting products and ownership of the product remains with Bling Boutique at all times.
Our products may be rented for customers who are under the age of 18 however we only rent directly to adults who may rent the products on behalf of a minor. By clicking “I accept” rental agreement button you represent that you are over 18 years and are authorised to use the chosen method of payment with the purpose of renting the products on the order.
Our Commitment to you
We will deliver the product that you have ordered including the correct size, colour, and style on or before the date you have specified for delivery on your order. Except where we have indicated to you that your request for this is not possible or guaranteed and therefore your order has been amended. Products may appear different in colour and style then the images listed on the website. Our liability to you for failure to deliver a product you have ordered is limited only to timely delivery.
Payment Terms
The “rental fee” for the products will be the rental fee and delivery fees and any additional charges listed on the website in relation to your rental of products. When you order a product you authorise Bling Boutique to charge your payment method for your rental fee. We will charge your Payment method immediately upon receiving your order. In addition to your rental order for a product, you authorise Bling Boutique to charge your payment method up to an amount to 100% of the entire original retail value of the product as set in the “retail value” on the website. Provided we only charge your payment method when you have not upheld your commitment to us as set forth in the rental agreement below.
Shipping Details
Bling Boutique only hires costumes to customers within Australia.
Delivery Australia wide is available and the shipping method will be the choice of the customer at checkout.
WARNING: If you are unavailable to sign for this delivery it may be taken back to the depot or post office for collection by you. It is your responsibility to be available for delivery of your item/s or collection of your item when you have not been available.
Once delivery has been made to your nominated address you bear all responsibility for the product. If you have opted to have your product delivered to your work address or mailroom, responsibility is passed to you as soon as the mailroom has signed for the product. A secure shipping address is highly recommended when placing your order. In the event that an unsecured shipping address is provided Bling Boutique does not bear any responsibility for the product left unattended. If you are unavailable to receive the item Bling Boutique will not be held responsible for additional shipping delays or additional shipping charged passed on by delivery service.
Costume Hygiene
Bling Boutique confirms the costume (including any accessories) will be clean and in good repair at the time of collection/ shipment to the customer.
Please DO NOT attempt to clean or launder the costume yourself. This includes any attempt to dry clean, machine wash, hand wash, bleach and/or tumble dry the costume (or any accessories).
All Bling Boutique costumes are carefully cleaned after each customer use prior to next hire. Use of this product is at your own risk and Bling Boutique shall not be held liable for any health-related complaints associated with a product rented from our site.
Product Fit and Returns
If a product doesn’t fit then you can return it unworn within 24 hours to receive a credit of the rental fee minus delivery charges. You must email kellie@blingboutique.com.au indicating your intention to mail back the product for credit. The term “unworn” will be determined by Bling Boutique and must be fulfilled prior to a credit being issued. Credits will only be issued if ALL of the items in the order were unworn.
Use of Bling Boutique’s products
You will treat the garment with the utmost of care.
The following are expectations of you for the duration of the rental:
DO NOT:
- Attempt to fit into a costume that is too small, or try put on a costume that is too tight and therefore damage the trims.
- Attempt to clean or launder the costume (including any accessories) without the express prior consent of Bling Boutique.
- Eat, drink (other than water) or smoke in the costume.
- Attempt to alter the costume in any way without the express prior consent of Bling Boutique.
- Attach sticky labels, badges or tape of any kind to any part of the costume.
- Pin, sew, glue or iron the costume.
- Travel in the costume. Costumes should be transported to a venue and not worn in the car.
- Allow other children to wear the costume.
DO:
- Wear appropriate undergarments while using the costume.
- Wear a protective jacket/cape over the costume when not performing.
- Transport the costume in a protective costume/garment bag at all times.
- Air out the costume after wearing (especially for longer rental durations).
- Store the costume in a costume/garment bag and in a safe location free from direct sunlight, smoke, pets and small children.
- Contact Bling Boutique as soon as possible if the costume is lost, damaged or stolen.
You are responsible for any damage to the costume due to fire, major stains, theft or loss. Normal wear and tear on costumes is expected and will not incur additional charges. Normal wear and tear is considered to be minor stains which can be removed in dry cleaning, small seam rips, a few missing beads and rhinestones.
Damages beyond normal wear and tear will incur additional fees (‘Damage Fee’) causing the customer to forfeit part or all of the Bond, depending on the degree of damage. Damages that will incur a Damage Fee include broken zippers, detached garment pieces, make-up/other permanent stains, and any other damage that render the costume incapable of being rented. The Damage Fee includes the cost of any supplies needed to restore the garment to its original condition as well as labour costs.
If the product is unable to be repaired you agree to pay up to the full retail value of the costume (as listed on our website), minus the bond. This price will be at the Discretion of Bling Boutique.
Alterations
Bling Boutique does not permit the customer to alter the costume (including accessories) in any way. The customer therefore MAY NOT cut, dye, or paint the costume. Additionally, tape, iron-on bonding-web, glue or any other type of adhesives MAY NOT be used on the costume.
Bling Boutique may work with the customer to allow minor alterations, however, such alterations must be capable of being reversed upon return.
The costume and any accessories must be returned in their original condition. If a costume is returned with alterations, fees will be charged. Such fees will be deducted from the Bond.
Rental Duration
Your rental period starts from the time the delivery service attempted first delivery and credits will not be issued for late delivery where you have not been available to accept delivery.
All costumes (including accessories) must be returned to Bling Boutique on or before the rental end date.
If you return your product late you will incur a ten dollar ($10.00) late fee for every day you are late, deducted from the security bond and then up to 100% of the retail value of the costume as indicated on our website. Bling Boutique will use the payment method you have provided to charge any late fees. You agree to pay these late fees up to an amount not exceeding 100% of the retail value of the products. Late fee is payable regardless of whether a customer is a new client or has used credit for their order. If you have not returned your product within 20 days of the return date your product will be considered a non-return and Bling Boutique will charge your payment card the maximum late fee as set above, less any late fee we have already charged you.
Returning your Costume
The costume will have been provided by Bling Boutique to the customer in appropriate packaging to ensure safe transport. The customer must return all items in the same manner.
In the event that a costume is returned to Bling Boutique with one or more items missing, the full amount of the Bond will be deducted.
The customer is responsible for chosen return methods and payments. Tracking numbers must be provided via email or Instagram message when the returning package has been lodged with the relevant postal operator (e.g. Australia Post). Bling Boutique will not be held liable for products that are late or lost in transit due to your chosen method of shipping.
The return address for hired costumes will be emailed to you at the beginning of the rental duration.
Bling Boutique will not take responsibility for lost articles mailed in Australia post boxes:
If you return your costume via an Australia Post Outlet (highly recommended) where it will be scanned over the counter as proof of lodgement then the article will be deemed as returned and we will accept responsibility for the article after the first scan. If you return your costume via an Australia Post Box and the package is not scanned and is lost by Australia Post then you accept responsibility for this loss and will be required to pay the retail cost of the costume less the rental fee already paid.
Bond
Bond may be recovered as follows:
(a) A full refund of the Bond will be issued to the customer’s nominated account within 10 business days from the date the costume is received by Bling Boutique, provided all the costume and any accessories are returned on time and in the proper condition (i.e. without damage and in appropriate packaging); or
(b) Any additional fees incurred by the customer will be deducted from the Bond. The remaining amount, if any, will then be issued to the customer’s nominated account within 10 business days from the date the costume is received by Bling Boutique.
Collection
If you do not pay the amounts owed to us when due we will pass on the invoices to a collection company to pursue you for collections, including and without limitation attorney and collection fees. Bling Boutique reserves the right to terminate your right to rent products from us at any time at our own discretion should you breach this agreement or for any other reason.
Cancellation Policy
Hire fees are non-refundable. If you cancel your hire and give us one week or more's notice, then we can happily issue you a credit note to be used within 12 months from the date of cancellation.
